General Description

Mr. Shaughnessy has served for ten years as the General Counsel for the International Division of Sumitomo Construction Co., Ltd and, after the merger of Sumitomo Construction Co., Ltd with Mitsui Construction Co., Ltd, for the International Division of Sumitomo Mitsui Construction Co., Ltd, currently the fifth largest construction company in Japan, with annual revenues of over $5,000,000,000.

His international practice experience has included drafting and negotiation of prime contracts, joint venture agreements and subcontracts, preparation and prosecution of claims for additional compensation for delays, change orders, lost productivity and time extensions, responsibility for all litigation and arbitrations, preparation and prosecution of insurance claims, insurance coverage and related risk management activities.

His duties required extensive travel throughout Asia. Mr. Shaughnessy has visited, and handled international construction legal matters, in the following countries:

Indonesia
Malaysia
Micronesia
Palau
Phillipines
Singapore
Thailand
United Arab Emirates
Vietnam

Mr. Shaughnessy has also handled international construction legal matters in the following countries (without ever visiting the countries)

OCAJI SEMINAR

An event of some significance in his international legal practice was a full day seminar given to the Overseas Construction Association of Japan (OCAJI) on July 29, 2004. The seminar was given by Masons Thelen Reid, LLP, a partnership of the law firms of Masons and Thelen, Reid & Priest, which has the largest construction law practice in the world. Mr. Shaughnessy, then Of Counsel with Thelen, Reid & Priest, organized the seminar and then presented the seminar with one other lawyer from Thelen, Reid & Priest and two lawyers from Masons.

Mr. Shaughnessy used his contacts with OCAJI member Sumitomo Mitsui Construction Co., Ltd to secure OCAJI's agreement to sponsor the seminar. Mr. Shaughnessy met with OCAJI management in Tokyo, worked with OCAJI to select the seminar topics, then drafted five of the six Powerpoint presentations given at the seminar.

The seminar was an unqualified success. Over one hundred people attended, from many of the leading construction and real estate firms in Japan. Simultaneous translation was provided during the seminar, which was followed by a cocktail reception.
